These Terms of Service ("Terms") govern your access to and use of FaceSwaply and its AI-powered photo and video tools. By creating an account or using the service, you agree to these Terms.

The service

FaceSwaply provides online AI tools including, without limitation:

• AI Face Swap and Video Face Swap
• Restore Face, Face Retoucher, and Age Progression
• AI Headshot Generator and AI Hairstyle Generator
• Photo to Cartoon, Photo to Emoji, Image Upscaler, Restore Image, and Background Remover

Features, credit costs, output quality, and availability may change over time. AI results are generated automatically and may vary based on input quality, settings, and model behavior.

Account requirements

You must provide accurate account information, keep your credentials secure, and use FaceSwaply only for lawful purposes. You are responsible for all activity under your account.

Most AI tools require a signed-in account. You must be old enough to enter a binding agreement in your jurisdiction.

Subscriptions and credits

Paid plans, subscriptions, and credit packs are described on our pricing and checkout pages. Fees are billed according to the plan you select. Credits are consumed when eligible AI jobs are submitted or completed, depending on the tool and workflow.

Except where required by law, charges already processed are non-refundable. See our Payments & Refunds Policy for more detail.

Your content

You retain ownership of photos, videos, and other content you upload, as well as outputs generated for you, subject to these Terms and applicable law.

By submitting content, you represent that:

• You own the content or have all necessary rights, licenses, and permissions to upload and edit it
• Your use of the content does not violate any law or third-party rights
• You have obtained consent from any identifiable person whose face or likeness appears in uploads or shared outputs, where required

You grant us a limited license to host, store, reproduce, transmit, and process your content solely to operate, secure, and improve the service.

Acceptable use

You agree not to use FaceSwaply to:

• Upload or generate unlawful, infringing, harassing, hateful, exploitative, or harmful content
• Create or distribute non-consensual intimate imagery or content that sexualizes a person without consent
• Impersonate another person, create deepfakes intended to deceive, or misrepresent edited media as authentic
• Defame, bully, humiliate, or endanger any person, including by placing someone into a false or damaging context
• Upload content involving minors in inappropriate, exploitative, or non-consensual scenarios
• Violate privacy, publicity, copyright, trademark, or other intellectual property rights
• Attempt to disrupt, scrape, reverse engineer, overload, or bypass usage limits or security controls
• Resell, sublicense, or misrepresent the service without our written permission

We may review, restrict, remove, or refuse content or accounts that violate these Terms or create risk for users or the platform.

AI output disclaimer

AI-generated results may be imperfect, unrealistic, or unsuitable for your intended use. You are solely responsible for reviewing outputs before sharing or publishing them.

FaceSwaply does not guarantee that outputs will be accurate, unique, free of artifacts, or fit for professional, legal, medical, identity, or employment purposes.

Intellectual property

FaceSwaply, its branding, software, website, and documentation remain our property or that of our licensors. Except for the limited rights needed to use the service, no rights are granted to you.

If you believe content on the platform infringes your rights, contact support@faceswaply.kong0.xyz with sufficient detail for us to review the claim.

Suspension and termination

We may suspend or terminate access if you violate these Terms, create security or legal risk, or fail to pay applicable fees. You may stop using the service at any time.

Disclaimer and liability

The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, and limit liability for indirect, incidental, special, consequential, or punitive damages arising from use of the platform.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Changes and contact

We may update these Terms from time to time. Material changes will be posted on this page. Continued use after changes become effective constitutes acceptance of the updated Terms.
